Although both the Context and Spirit Sun cuts are “protected”, I
doubt that protection would hold up in court. The Spirit Sun is
identical to the old “Spinning Wheel” cut published in the Vargas
books and long a favorite of beginning cutters back into the 1960’s.
The “Context” is a cut that is often used to teach beginners basic
handling of the rough and their cutting machine, and likewise
appears in the literature and common usage long before this
so-called “protection” came about. IMO, they are public domain, and,
at the least, they are derivative and therefore should not be
eligible for protection. I don’t think the protection would hold up.
I have cut both of those designs for many years before the so-called
protection was instated, and have no intention of not cutting them
when called for in the future.
They are public domain, pure and simple.
