Casting Buddies

I'm a little confused. If this is her sapphire and diamond
engagement ring, it is a traditional wire mounting design.
Simply a large sapphire with maybe 14 diamonds surrounding it.
Can such a thing really be copyrighted? There is nothing about
this ring that is innovative or new.

yes but if someone has managed to get a copyright on the piece,
then the casting company could have big financial problems…

Hi Chris, I didn’t know that the ubiquitous sapphire and diamond
cluster design was patented or owned legally by anyone(?). Regards,
Rex from Oz

At what address can I send you a drawing of proposed design and
get more info on price etc.

This particular ring is not the blue sapphire one that is
surrounded by diamonds that Prince Charles gave her. It is the
ring that Dodi Fayed gave her, but I will modify it slightly to
suit my customers needs. I am doing a price quote now on the
diamonds.

Hi Gang,

Doesn’t a copywrited design have to be marked with the copywrite
mark?

Dave

Hi , yes legally this is true regarding the copyright if there is
one on the infamous Sapphire and Diamond Ring but there are
probably a zillion out there, so how do you control something like
this years later. I don’t condone it, but on another issue is all
the knock-offs on the watches, they are illegal but this does not
stop anyone from making and selling them all over the internet. Have
a nice Day!

The best thing to do if you have a question about the legallity of
an action and are not familiar with the law, is to consult a
lawyer. General ly speaking, layman’s legal advice isn’t worth the
time takes to listen to it.

Anybody can copy or sell anything the they want, they just have to
accept the legal consequences.

Rick,

I don’t know whether you are aware of it or not, but a company is
currently being sued over the Titanic necklace design you
mentioned in your post. Check out http://www.gemkey.com/ for
short news clip.
