against it's author (the insurer). Also remember that few people
are ready and willing to take their case all the way with an
insurer, and that insurers bank on your willingness to accept "no"
for an answer.

Not only do they bank on you not going after them, they quite
often crumble and pay rather than pay the expenses of going to
court. Look at all the life insurance frauds they pay for and all
the ‘planned’ auto accidents they pay for. Makes you really mad
when they don’t pay legitimate claims.
